NOTICE OF PUBLIC HEARING ON THE APPLICATION OF ALBANY UNIFIED SCHOOL DISTRICT FOR A WAIVER OF BONDING CAPACITY FROM THE  CALIFORNIA BOARD OF EDUCATION WITH RESPECT TO THE DISTRICT’S  AUTHORIZED GENERAL OBLIGATION BONDS

NOTICE IS HEREBY GIVEN that at 6:00 p.m., or as soon thereafter as practicable, on December 9, 2025, the Board of Education (the “Board of Education”) of the Albany Unified School District (the “District”) will conduct a meeting at Albany City Hall, 1000 San Pablo Avenue, Albany, CA 94706, and via video conference/teleconference. Participation details will be posted with the agenda. This meeting will provide public comment opportunities in person or through the Zoom app or by telephone. At this meeting, the Board of Education will hold a public hearing on the proposal that the District submit an application to the California Board of Education (the “CBE”) for a waiver of the District’s bonding capacity (the “Waiver”) pursuant to Sections 15106, 15270 and 33050 of the California Education Code, being the limitation on the District’s ability to issue its general obligation bonds (“Bonds”) in an outstanding principal amount in excess of 2.5% of the assessed valuation of taxable property within the District (the “Assessed Value”).

In the event that the CBE should grant the Waiver, the District would thereafter be authorized to issue Bonds at any time until June 30, 2038, so long as the outstanding principal amount of such Bonds at the date of issuance did not exceed 3.59% of the District’s Assessed Value.

At the hearing, the testimony of all interested persons for or against the submission of an application for the Waiver, its amount and duration, will be heard.

Any interested person may also offer public comment either in person or virtually via Zoom as listed in the meeting agenda, found on the District website (https://www.ausdk12.org).
